    On Thursday, 1st August 2024, we hosted a Data Protection Conference in partnership with Absa Bank Kenya bringing together key stakeholders from various sectors to discuss the evolving landscape of data privacy and the role of technology in safeguarding information. The event featured thought-provoking keynote addresses and panel discussions, offering valuable insights into the challenges and opportunities in data protection.<\/p>\n

    The Balance Between Innovation and Privacy<\/strong><\/p>\n

    \n

    Immaculate Kassait, the Data Protection Commissioner, delivered a compelling keynote address highlighting the importance of data privacy in the digital economy. She emphasized the crucial role of artificial intelligence (AI) in safeguarding information and stressed the need for organizations to prioritize trust and compliance. She also encouraged African nations to lead in developing and implementing data privacy technologies, emphasizing the importance of local solutions and expertise to protect digital rights and promote economic growth.<\/p>\n<\/blockquote>\n

    Immaculate further addressed the growing need to align marketing initiatives and data privacy regulations. She called for a balanced approach that respects consumer privacy while leveraging data for business growth. Additionally, she highlighted the challenges of managing data across borders and underscored the importance of regulatory compliance and robust governance structures to protect sensitive information in an interconnected world.<\/p>\n

    The Role of AI in Data Protection<\/strong><\/p>\n

    The first panel delved into the role of AI in enhancing data protection. Priya Shah,<\/p>\n

    Director Risk & Privacy Compliance at M-Tiba emphasized the importance of human oversight in AI use, \u201cWhile AI is created and directed by humans, ethical considerations must remain central,\u201d Priya noted. She further emphasized the need to maintain control over AI’s direction and ethical use is essential to prevent potential overreach. Priya also discussed the complexities of managing consent, especially in healthcare, stressing the need to align practices with consumer rights and ensure clear, specific consent to maintain trust and compliance.<\/p>\n

    Sharon Holi, Head of Customer Privacy, Data Protection Office at Safaricom PLC, on the other hand, shared insights from Safaricom\u2019s data protection journey, which began in 2015 with the General Data Protection Regulations (GDPR). She emphasized the importance of privacy by design, transparency, and data minimization in building trust and aligning with best practices.<\/p>\n

    Data Protection in the Cloud and International Transfers<\/strong><\/p>\n

    The second panel focused on the shared responsibility model in cloud computing, particularly regarding data destruction. Participants discussed the need to understand the responsibilities of both businesses and cloud providers, ensuring compliance with specific requirements and standards. They also explored the challenges of data protection in international transfers, emphasizing the need for compliance with local and international standards and the use of encryption and tokenization for security.<\/p>\n

    The panel further highlighted the importance of clear and understandable consent, especially in multilingual regions. Using AI-powered translation tools or local language experts can help ensure that consent forms are available in all relevant languages.<\/p>\n

    The Conference underscored the importance of staying informed and adaptable in the rapidly evolving data protection landscape. As we navigate the complexities of cloud computing and AI, we need to keep abreast of regulatory changes to ensure compliance and safeguard privacy. Implementing robust security measures is fundamental to protecting sensitive information and maintaining the integrity of data systems. Equally important is fostering clear and transparent communication with all stakeholders, which helps build trust and ensures that everyone is aware of their roles and responsibilities in data protection.<\/p>\n

    By embracing these best practices, organizations can better manage the challenges of data protection and leverage technology to create a secure and trustworthy digital environment.
